angryStop Our City has nearly run out of funds. Bill Smart – their bankroll – has cut-off his checkbook. There is grumbling in the SOC ranks about lack of yard signs, magnets and t-shirts. Some are questioning the group’s rental of office space and its support of Charles Fairchild’s BLAB TV show. Who made those decisions? Shouldn’t the money have been spent wiser? The BLAB show gave Marty a platform to campaign for re-election without him having to pay for it.

    Marty is the slickest politician of them all – playing the populist while using PAC money to build his power base and scare off competitors. Why did they start the BLAB show in 2005 – way before the Council vote in March, 2006?

    There is a conspiracy involved with the park – but it’s not Studer. It’s Dononvan and Fairchild.

    The SOS/Fairchild machine is finally self destructing. I love the fact that these dinosaurs who hate EVERY new proposal can’t manage a few thousand dollars but want to tell everyone else how to manage multi-million dollar projects.

    The SOS website is a pathetic mishmash of absolutely FALSE statements. They can’t win with the truth so no they are resorting to outright lies.

    C.C. Elebash, the mouthpiece – emeritus of the PAC has been against every new, modern and progressive thought to ever come down the pike. Let me remind you of a few, Elebash actively campainged against:

    Renovation of the Saenger Theater
    Development of the Cultural Center
    Building the UWF Arts Complex
    Development of the Port of Pensacola
    Building the Pensacola Civic Center
    Keeping the USS Lexigton in town as a museum

    The list is endless. Don’t let the fossils strangle our city any longer, make Pensacola proud again, vote YES on the Maritime Park!

    Committee for Community Maritime Park violations of campaign laws

    The Committee for Community Maritime Park has violated the following section(s) of Chapter 106, Florida Statutes:

    Section 106.06 (1), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the Committee for the Community Maritime Park willfully failed to “keep detailed accounts, current within not more than 2 days after the date of …making an expenditure”(expenditures were made throughout December 2005 that went unreported on Q4 Report);

    Section 106.07(4)(a)(1), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the
    Committee for Community Maritime Park willfully failed to file reports of all expenditures made, by or on behalf of the committee (The committee contracted expenditures to the John Applyard Agency, Inc., in the sum of $40, 096.97 for media advertising to promote the community maritime park. The advertising campaign was conducted during the month of December 2005. Contributions to cover this expenditure were made on January 12, 2006 by Quint Studer. Payment for the advertising and reporting of the expenditure came a month after the expenditure was made);

    Section 106.07 (4)(a)(9), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the Committee for Community Maritime Park willfully failed to report the “total sum of expenditures made by such committee….” (He did not report the media campaign of December 2005 on Q4 Report);

    Section 106.07 (4)(a)(13)(5), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the Committee for Community Maritime Park willfully failed twice to report in-kind legal contributions from the law offices of Clark, Partington, Hart, Larry, Bond & Stackhouse, for legal work, including but limited to extensive legal advice, research and correspondence (see letters from Robert D. Hart, JR. to Mr. David H. Stafford, Escambia County Supervisor of Elections on January 12, 2006 and April 17, 2006 for the Committee for Community Maritime Park) and 106.055 Valuation of in-kind contributions.—“Any person who makes an in-kind contribution shall, at the time of making such contribution, place a value on such contribution, which valuation shall be the fair market value of such contribution.”;

    Section 106.07 (13)(5), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the Committee for Community Maritime Park did falsely “certify the correctness” of the Q4 Report “knowing that such report is incorrect, false, or incomplete….”;

    Section 106.11(b)(3)(4), Florida Statutes, J. Mort O’Sullivan, III, Treasurer of the Committee for the Community Maritime Park willfully authorized expenditures for the purchase of media goods and services and accepted those goods and services without
    “sufficient funds on deposit…to pay the full amount of the incurred expense….” (John Applyard Agency, Inc., $40, 096.97 purchase of media goods and services).

    Section 106.147(2), Florida Statutes, the Committee for the Community Maritime Park made multiple telephone solicitations and failed to file “written authorization…with the qualifying officer…prior to the time the calls commence.”;

    Section 106.19(1)(b)(c)(d), Florida Statutes, the Committee for the Community Maritime Park failed “to report any contribution required to be reported….” And falsely reported or deliberately failed to include information required and expenditures prohibited by Chaptor 106 of the Florida State Statutes;

    I wonder if or how quinty is claiming all of the t-shirt give aways, flyer hand outs, or public announcements at his pelican games on his tax reports??? Anyone got the answers? Thanks

    The next reports are due 9/30/06. The Committee for the Community Maritime Park financials can be found on Supervisor of Elections website. Any materials on CMP that I’ve seen at the games are marked as paid for by the committee.

    What does it matter? Anything handed at games is probably “preaching to the choir.”

    Nope, I don’t support it, but am exposed to it. And you ask “what does it matter?” The matter is , that if he is NOT claiming it, it is Illegal….Seems ALOT of folks around here do quit a bit of that.

    The materials are marked as paid for by the committee supporting the park.

    If you believe it’s illegal, report it to the Elections Supervisor. In fact, you have an obligation to do so. Then let us all know what he says. The office number is 595-3900.

    I see no facts or corner that I’ve been painted into. You ask a question about the materials handed out at the park. I write that they are marked as being paid by the park committee, but I tell you if you believe something is illegal that you should report it.

    It’s all fairly straight forward. If someone from the committee for the park hands you something supporting the park that isn’t properly mark as being paid for by the political action committee, then it should be reported to the Supervisor of Elections.

    We haven’t seen any such material that hasn’t been properly marked.
